The ICC Prosecutor is the head of the Office of the Prosecutor at the International Criminal Court (ICC), responsible for investigating and prosecuting individuals for alleged crimes such as genocide, war crimes, and crimes against humanity. In late 2024, the ICC issued arrest warrants for Benjamin Netanyahu, the former Prime Minister of Israel, and Yoav Gallant, the former Israeli Defense Minister, over their alleged involvement in genocidal conduct during the Israeli military operations in Gaza since October 2023. These warrants marked a historic moment, as they were the first ever issued against the leadership of a Western-allied state by the ICC.
The United States responded to the warrants with significant political and financial pressure, including sanctions imposed on the ICC prosecutor and the court itself. The Trump administration further escalated this by imposing additional sanctions in 2025 and threatening further measures against any state that cooperated with the ICC’s requests. The ICC’s actions have been widely seen as a formal legal challenge to Israeli conduct, with the court’s findings suggesting that the operations in Gaza may constitute genocide. Despite these legal actions, the Israeli government has not complied with the ICC’s orders, including those issued by the International Court of Justice (ICJ), which had previously ruled that Israel must take steps to prevent genocide in Gaza.
The role of the ICC Prosecutor has thus become central to the ongoing international legal and political struggle over the legitimacy of the Israeli military operations and the accountability of its leadership for potential genocidal actions.
